These Terms and Conditions (“Terms”) govern your use of the Famly mobile application and web platform (“App” or “Platform”). By using Famly, you agree to follow these rules.
1.0 About These Terms
1.1 What This Document Is
These Terms and Conditions ("Terms") govern your use of the Famly mobile application and web platform ("App" or "Platform"). By using Famly, you agree to follow these rules.
1.2 Who We Are
Famly is a digital cooperative platform operated by Famly Multipurpose Cooperative Society (Famly MCS), a cooperative society registered in Nigeria. Our registered address is 36 Sokode Crescent, Wuse Zone 5, Abuja, FCT.
1.3 Your Agreement
When you download, register for, or use Famly, you agree to these Terms. If you don't agree, please don't use our App.
1.4 Changes to Terms
We may update these Terms from time to time. We will notify you through the App or via email at least 30 days before changes take effect. Continued use of the App means you accept the new Terms.
2. ELIGIBILITY AND REGISTRATION
2.1 Who Can Join
To use Famly, you must:
- Be 18 years and above
- Have a valid Nigerian identification document
- Provide accurate information during registration
2.2 Registration Process
To become a member, you must:
- Complete the registration form
- Pay the one-time registration fee
- Verify your identity with a valid Nigerian ID
- Set up your contribution amount
2.3 Account Security
You are responsible for:
- Keeping your login details secure
- Not sharing your account with others
- Reporting any unauthorized use immediately
- Updating your information when it changes
3. MEMBERSHIP AND CONTRIBUTIONS
3.1 Membership Structure
All members join under a single membership structure with equal access to platform features and services.
3.2 Monthly Contributions
As a member, you must:
- Make your monthly contribution by the due date
- Contribute a minimum amount of ₦5,000 monthly
- Use approved payment methods only
3.3 How Contributions Work
Your monthly contributions are allocated as follows:
- 60% goes to your savings balance
- 40% goes to your contributions balance, which is pooled together for a profitable venture/scheme
- Contribution profits are shared annually based on cooperative performance
3.4 Missed Contributions
If you miss contributions:
- First missed payment: Reminder notification
- Second missed payment: Account warning
- Third missed payment: Account warning
- Fourth missed payment: Account warning
- Fifth missed payment: Account warning
- Sixth consecutive missed payment: Account suspension
- To reactivate: Pay monthly contribution and maintain for 3 months in a row.
3.5 Contribution Adjustments
You may:
- Increase your contribution amount anytime
- Request to adjust your contribution amount before the next due date, but not below the minimum ₦5,000 monthly requirement
4. GROUP BUYING AND DEALS
4.1 How Group Buying Works
Group buying allows members to purchase goods and services together at discounted prices. Deals are activated only when minimum participation levels are reached.
4.2 Participation Rules
When joining group deals:
- Pay the full required amount for the specific deal
- Complete payment within the deal timeline
- All sales are final once deal activates (this means once enough members join, and the deal becomes active; you cannot cancel your purchase or get a refund - you are committed to complete the transaction and receive the goods or services)
4.3 Deal Cancellation
If a deal doesn't reach minimum participation:
- Full refund of payments within 24 hours
- No penalties for members
- Alternative similar deals may be offered
4.4 Product Quality and Delivery
- All vendors are pre-approved by Famly
- Delivery timelines are provided for each deal
- Quality complaints handled through our dispute resolution process
- Famly facilitates but doesn't guarantee vendor performance
5. PAYMENTS AND FEES
5.1 Registration Fee
- One-time payment of ₦2,000 required to activate membership
- Non-refundable after account activation
5.2 Service Charges
We charge service fees for:
- Payment processing by our service provider: 1.5% of contribution amount (capped at ₦2,000)
- Group buying service charge: ₦2,500
- Other services as clearly disclosed
5.3 Payment Methods
Accepted payment methods include:
- Bank transfers
- Card payments (Debit/Credit cards)
- Other methods as announced
5.4 Failed Payments
If payments fail:
- We will send you a notification
- You can retry the payment using the same or different payment method
- We understand that payment failures can occur due to technical issues
6. CONTRIBUTIONS, SAVINGS AND INVESTMENTS
6.1 Contribution Allocation
Your monthly contributions are automatically split:
- 60% into your personal savings balance
- 40% into your contributions balance for collective funds pooling
6.2 Contribution Process
The 40% contribution portion:
- Is pooled with other members' contributions
- Is put into profitable ventures by Famly MCS on behalf of all members
- Decisions are made by the cooperative management
- All profitable ventures carry risk, and returns are not guaranteed
6.3 Profit Sharing
- Cooperative profits are calculated annually
- Profits are shared among members based on their contributions and cooperative performance
- Profit distribution occurs at the end of each financial year
6.4 Withdrawals
- Members can withdraw funds from their savings balance (60% portion) only
- Withdrawals are processed through their personal wallet on the platform
- Contribution balance (40% portion) cannot be withdrawn individually - it remains in collective funds pool until the end of the year.
- Withdrawal requests are subject to processing times and any applicable terms
7. DATA PROTECTION AND PRIVACY
7.1 Information We Collect
We collect information necessary to provide our services, including:
- Personal identification details
- Financial information
- Transaction history
- App usage data
7.2 How We Use Your Information
Your information is used to:
- Provide and improve our services
- Process transactions
- Communicate with you
- Comply with legal requirements
- All data processing is conducted in accordance with Nigeria Data Protection Commission (NDPC) guidelines
7.3 Information Sharing
We don't sell your personal information. We may share information:
- With service providers who help operate our platform
- When required by Nigerian law
- With your explicit consent
- In accordance with NDPR requirements
7.4 Data Security and Compliance
We implement appropriate security measures to protect your information and are NDPR certified. However, no system is 100% secure. Report any suspected security breaches immediately.
8. PROHIBITED ACTIVITIES
8.1 What You Cannot Do
You must not:
- Use the App for illegal activities
- Provide false information
- Attempt to hack or disrupt our systems
- Share your account with others
- Use the platform to harass other members
- Violate any Nigerian laws or regulations
8.2 Consequences
Violation of these rules may result in:
- Account warnings
- Temporary suspension
- Permanent account closure
- Legal action if necessary
9. DISPUTES AND COMPLAINTS
9.1 Internal Resolution
If you have complaints:
- First contact our customer support team
- We aim to resolve issues within 7 working days
- Escalation process available for unresolved matters
9.2 External Resolution
For unresolved disputes, you may:
- Contact relevant Nigerian regulatory authorities
- Seek mediation through recognized bodies
- Pursue legal action in Nigerian courts
10. LIMITATION OF LIABILITY
10.1 Our Responsibilities
Famly MCS operates as a digital cooperative platform connecting members and facilitating transactions within Nigeria's regulatory framework. We are not responsible for:
- Actions of other members or vendors
- Technical failures beyond our control
- Market performance affecting investments
- Force majeure events
10.2 Financial Limits
Our liability to you is limited to the amount of fees you have paid to Famly MCS in the twelve (12) months preceding any claim.
11. ACCOUNT TERMINATION
11.1 Your Right to Leave
You may close your account anytime by:
- Providing 30 days written notice
- Completing all pending transactions
- Withdrawing available balances (subject to terms)
11.2 Our Right to Suspend/Terminate
We may suspend or close accounts for:
- Breach of these Terms
- Fraudulent activity
- Extended non-payment
- Legal or regulatory requirements
11.3 Effects of Termination
Upon account closure:
- Access to platform features ends
- Outstanding obligations remain due
- Available balances returned according to withdrawal terms
12. INTELLECTUAL PROPERTY
12.1 Our Rights
Famly MCS owns all rights to:
- The App and platform
- Our trademarks and branding
- Content we create
12.2 Your Rights
You retain the right to information you provide but grant us license to use it for platform operations.
13. GENERAL PROVISIONS
13.1 Governing Law
These Terms are governed by Nigerian law. Any disputes will be resolved in Nigerian courts.
13.2 Entire Agreement
These Terms, together with our Privacy Policy, constitute the complete agreement between you and Famly MCS.
13.3 Severability
If any part of these Terms is found invalid, the remainder will continue to apply.
13.4 Force Majeure
Neither party is liable for delays or failures due to circumstances beyond reasonable control.

15. REGULATORY COMPLIANCE
Famly MCS operates as a digital cooperative platform in compliance with Nigerian cooperative laws, financial regulations, and data protection requirements. We maintain all necessary registrations and approvals for our operations as a cooperative society in Nigeria.
